Epic! “Blast Off To Reading” Contest Official Rules (the “Rules”) NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where any aspect of the Promotion is prohibited by law or where registration or bonding is required. All federal, state, and local laws and regulations apply.
Sponsor. The Sponsor of this Promotion is Epic! Creations, Inc., 228 Hamilton Avenue, floor 3, Palo Alto, CA 94301 (“Epic!”).
Promotion Description. The Epic! Creations “Blast Off To Reading” Contest (the “Promotion”) is a skill contest to determine the most active group of school classroom readers using the Epic! Platform during the Promotion Period (as defined below). The Promotion begins on 12:01 a.m. U.S. Pacific Time (“PT”) November 4, 2019 and ends on 11:59 p.m. PT on November 10, 2019 (the “Promotion Period”). Sponsor’s computer shall be the official time keeper. Epic! reserves the right to modify or discontinue the Promotion (including modifying the Rules) at its discretion.
There shall be two winning classrooms at each grade level, pre-K through sixth grade, resulting in a total of 16 winning classrooms. Each winning classroom will receive (i) a $500 cash prize (awarded to teacher) to be used for classroom activities or a classroom social event; (ii) 6 months of free access to the Epic! platform for all students in the classroom (up to 40 home subscriptions per classroom); and (iii) an original Epic! print book (up to 40 books per classroom). Prizes shall generally be awarded within thirty days following the end of the Promotion Period. Prizes will be awarded to the teacher.
The total prize value each winning classroom for the Promotion Period shall not exceed USD $2,978.00. Total value of all prizes is USD $47,648.00.
How To Enter. Teachers and their classrooms will automatically be entered into the Promotion as existing Epic! platform users in their classrooms for in-class reading done. For students who would like to access the Epic! platform from home during the Promotion Period to have their home reading on the Epic! platform also qualify, their parents may register for the Epic! platform for free student usage during the Promotion Period by utilizing the registration code provided by their child’s teacher and registering on the Epic! platform using the specially provided link and providing an email address.
Eligibility. In order to be eligible, participants must be 18 years of age or older, at least the age of majority in their jurisdiction of residence, a teacher or a parent of a student in a registered teacher’s class, and, in order to be eligible to receive a prize, a legal resident of (who is currently residing in) one of the 50 United States. Teacher participants must also be Epic! platform members prior to the beginning of the Promotion Period and for the duration of the Promotion. Entries are limited to individuals only. Directors, officers, employees, contractors and agents of Epic!, its subsidiaries, affiliates, resellers, or advertising or promotional agencies and members of their immediate families (defined as children, parents, siblings or spouses) are not eligible to participate in the Promotion. By participating or accepting a prize, you represent that you are eligible to participate (and that your children may participate), including that your participation would not violate any employer or third- party policies.
Identity of Participants; Limitations on Entries. Epic! will have the right to determine identity of participants in its sole discretion. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to falsify the number of books read is prohibited and will result in immediate disqualification.
How Your Class Wins. Your class will be competing only against other classes at its grade level. The contest is to see which class in your grade level can read the most using the Epic! platform during the Promotion Period. All reading on the Epic! platform counts, whether you’re reading in class or at home. The volume of reading will be determined based on Sponsor’s algorithm measuring the quantity of reading done on the Epic! platform by all students in a teacher’s class.
TIEBREAKER: In the unlikely event of a tie, the winner will be the class that achieved its reading status first.
Epic!’s decisions are final in all matters related to the Promotion.
Notification. Epic! will attempt to notify winners by email or via the Epic! platform within approximately ten (10) days following the determination of each winning class. Epic! is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or winner’s failure to adequately monitor any account. The winner must then respond to Epic! within five (5) days. Should a winner fail to respond to Epic! or be disqualified, Epic! reserves the right to select a new, replacement winner. Unclaimed prizes will not be awarded. The winners will be listed online for a period at https://www.getepic.com/blast-off-to-reading within approximately ten (10) days following the end of the Promotion Period. Individuals may request the name of the winners by submitting a self-addressed, stamped envelope within 90 days of the end of the Promotion Period to: Epic! Creations Blast Off to Reading Contest Winners Request List, 228 Hamilton Avenue, floor 3, Palo Alto, CA 94301. VT residents need not include return postage. By participating, you agree to Epic!’s inclusion of your name, and the city or town and country of your residence on such list if you are a winner.
Affidavit; Publicity Release. Each participant (and parents of students in winning class) may be required to sign an affidavit of eligibility, liability waiver and publicity release that will allow Epic! to use the winner’s and/or their child’s name and school information for publicity and promotional purposes without further compensation where permitted by law.
Taxes. All taxes associated with the receipt or use of the prizes are the sole responsibility of each winner. Epic! reserves the right to withhold any taxes as required by applicable law. Prizes are not transferable. No substitutions (including for cash) are permitted, but Epic! reserves the right to substitute a prize of equal or greater monetary value to the prizes if for any reason any prize cannot be awarded as contemplated in these Rules.
Conditions of Participation. By participating in this Promotion, you agree to abide by these Rules, the terms and conditions of Epic!, and any decision Epic! makes regarding this Promotion. Epic! reserves the right to disqualify from the Promotion, and any future giveaway or other promotion conducted by Epic!, and to take such other action as may be appropriate, any participant or winner who, in Epic!’s reasonable suspicion, tampers with Epic!’s website, the Epic! platform, the entry process, intentionally manipulates the Promotion, violates these Rules, or acts in an unsportsmanlike, prohibited or disruptive manner.
Disclaimer and Limitation of Liability. EPIC! MAKES AND GIVES NO REPRESENTATIONS, CONDITIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE PROMOTION OR ANY PRIZE OR ANY PARTICIPANT’S PARTICIPATION IN THE PROMOTION. EPIC! SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM, ANY OCCURRENCE, EVENT OR CONDITION OUTSIDE EPIC!’S REASONABLE CONTROL THAT MAY AFFECT THE PROMOTION OR CAUSE THE PROMOTION TO BE DISRUPTED, SUSPENDED OR CORRUPTED, INCLUDING: (I) LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE ENTRIES, CONTACT INFORMATION OR REFERALS; (II) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND; (III) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; AND (IV) THE DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THIS PROMOTION. EPIC! RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND OR CANCEL THE PROMOTION OR ALTER THE RULES IF AT ANY TIME, INCLUDING IF A COMPUTER VIRUS, TECHNICAL PROBLEM, OR OTHER UNFORESEEABLE OCCURRENCE, EVENT OR CONDITION ALTERS OR CORRUPTS THE ADMINISTRATION OF THE PROMOTION.
Release. BY ENTERING THE PROMOTION, EACH PARTICIPANT RELEASES AND AGREES TO HOLD HARMLESS EPIC! AND ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, THOSE RELATED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION), ARISING OUT OF OR IN CONNECTION WITH: (I) ENTERING OR PARTICIPATING IN THE PROMOTION; (II) ACCEPTANCE OR USE OF ANY PRIZE; OR (III) OTHERWISE ARISING OUT OF OR RELATING TO THE PROMOTION.
Privacy and Use of Promotion Information. Any personal information received by Epic! in connection with this Promotion will be used solely in accordance with Epic!’s privacy policy, which can be found at https://www.getepic.com/privacy.
GOVERNING LAW AND DISPUTES. THESE RULES AND THE CONTEST ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA AND THE UNITED STATES AND THE FORUM AND VENUE FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES SHALL BE IN THE COUNTY OF SAN MATEO COUNTY, CALIFORNIA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN CALIFORNIA. ANY SUCH CONTROVERSY OR CLAIM WILL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND WILL NOT BE CONSOLIDATED IN ANY ARBITRATION WITH ANY CLAIM OR CONTROVERSY OF ANY OTHER PARTY. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF SAN MATEO, CALIFORNIA, UNITED STATES. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
